Terms and Conditions
Effective Date: September 1, 2023
Congratulations on your decision to begin your wellness journey! With the help of your personal trainer, you greatly improve your ability to accomplish your training goals faster, more safely, and with maximum benefits. Tools and skills you acquire from your training sessions can be used for a lifetime. In order to maximize progress, it will be necessary for you to follow program guidelines during supervised and (if applicable) unsupervised training days. Remember, exercise and healthy eating are equally important! It is recommended that clients work with their personal trainer three (3) times per week. However, due to scheduling conflicts and financial considerations, a combination of supervised and unsupervised workouts is possible.
These terms and conditions form part of your agreement with Welcome Wellness LLC (“Welcome Wellness”) and with your personal trainer (“Trainer”) who delivers your training. Your instructions to commence personal training will constitute acceptance of these Terms and Conditions at which time you will become a client (“Client” or “you”). This does not affect your statutory rights.
General
Welcome Wellness reserves the right to change its services, prices, fees, and Terms and Conditions at any time, for example, to be able to offer new services or as required by law. Welcome Wellness will notify you of any change to the Terms and Conditions. When such a change(s) is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.
This agreement is governed by Federal and State laws and is subject to the jurisdiction of the courts.
Trainer’s Obligations
The Trainer will use their skills and knowledge to design a safe program of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history. The Trainer will provide the coaching, supervision, advice and support that you will need to achieve your goals.
Each appointment or personal training session (including the initial consultation) will last approximately sixty (60) minutes unless otherwise agreed (a “Session”).
You understand that the results of any fitness program cannot be guaranteed. Your progress depends on your effort and cooperation in and outside of the Sessions. You acknowledge that individual results may vary and that no particular result is guaranteed by your Trainer.
Your Obligations
It is understood between you and your Trainer that both must commit to your training program 100% in order for you to achieve results. You are required to arrive on time for each Session so that the Trainer’s full training plan is achieved on each visit.
You are required to wear appropriate clothing and footwear.
You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) before undertaking your first personal training Session. Your Trainer may require a letter of ‘medical clearance’ from your General Practitioner (GP) or equivalent medical professional.
You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury. If your Trainer requires further medical information from a practitioner, you must provide such details. Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.
If you bring children or minors to the Session, they remain your responsibility throughout and the Trainer cannot be held liable. If your Trainer conducts the Sessions on your premises, you are responsible for providing a safe exercise environment.
You are responsible for keeping all your contact information and payment information up to date with the Trainer.
Health and Safety
Your Trainer has completed and holds a current certificate for CPR/AED (Cardiopulmonary Resuscitation and Automated External Defibrillator) by the National CPR Foundation.
During your personal training Sessions, every effort will be made to assure your safety. However, as with any exercise program, you understand that there are inherent risks in participating in a program of strenuous exercise.
By commencing personal training, you agree to assume responsibility for these risks and waive any possibility for personal damage. You also agree that, to your knowledge, you have no limiting physical conditions or disability that would preclude an exercise program. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by their gross negligence or intentional act.
By accepting these Terms and Conditions, you accept full responsibility for your own health and well-being and you acknowledge an understanding that no responsibility is assumed by Welcome Wellness or your Trainer.
Promotions and Packages
For the purposes of this agreement, a “month” is defined as twenty-eight (28) calendar days.
Promotions. Promotional offers expire 3 weeks from the date of scheduling, after which any unused Sessions and benefits will be lost without refund and will not be carried over into the following months. This is to ensure the Trainer will be able to deliver all your required Sessions in a timely manner to enable you to achieve your goals.
Packages. A Package is a recurring monthly subscription. Purchase of a Package includes Unlimited Sessions. “Unlimited” means there is no limit to the total number of Sessions booked within a month, subject to the Trainer’s availability.
By accepting this agreement, you authorize Welcome Wellness to charge recurring payments, as applicable, to the payment method you have provided which is kept on file.
Welcome Wellness may allow the monthly fee to be paid in four (4) weekly installments.
Packages must be canceled at least five (5) calendar days prior to the next payment date to guarantee that the Client does not incur payment for that billing cycle.
On a case-by-case basis and at Welcome Wellness’ sole discretion, Welcome Wellness may allow the temporary pausing/suspension of Packages due to extenuating circumstances such as serious illness/injury or sudden and unexpected financial hardship. Welcome Wellness may ask you to provide proof from your GP or equivalent medical professional.
Lateness Policy
If the Client is late to the Session, it cannot be extended and will end at the appointed time. If the Trainer is late, additional time will be added to the Session or to subsequent Sessions. If you are more than 15 minutes late, your Trainer may choose to cancel the Session and you may lose that Session, in which case no refund will be made.
All payments must be made in full prior to any Sessions taking place.
You are advised to retain a copy of this agreement, the terms and conditions, and receipt for any payment of Session purchases you make.
In the case of declined or failed payments, you will have fourteen (14) calendar days to update your payment information by contacting your Trainer. You will receive notification via email regarding unsuccessful payments, and the payment processing system will automatically retry payment attempts. If you fail to rectify unsuccessful payments within 14 calendar days, Welcome Wellness reserves the right to cancel your Package and/or Sessions without refund.
Cancellation and Refunds
Twenty-four (24) hours’ notice of cancellation or postponement is required for all Sessions. Notice of less than 24 hours will incur full payment of the full Session fee. For Packages involving Unlimited Sessions, no-shows or notice of less than 24 hours will incur a fee of $100 per missed Session.
Any rescheduled or postponed Sessions will take place at a time mutually agreed upon between you and the Trainer.
Once purchased, Sessions and Packages are non-refundable and non-transferable.
In the unlikely event of your Trainer being unable to continue your training, for any reason, you can request a refund from your Trainer for any unfulfilled Sessions. Any other refunds are at the discretion of Welcome Wellness.
Privacy and Confidentiality
All Client information will be kept strictly private and confidential. In order to comply with the applicable client confidentiality and privacy laws, the Trainer will only do what you ask them to do, or what you have given them permission to do, with any personal or sensitive information held about you. Your training may be filmed or pictures taken for marketing purposes. Your participation in a Session means you consent to photography, filming, and sound recording which may include you, and consent to its use in commercial distribution without payment or copyright. You may revoke your consent to photography, filming, and sound recording at any time by providing written notice.
